NDC injuncts EC over Amenfi Central case

The National Democratic Congress (NDC) has served the Electoral Commission (EC) with an interlocutory injunction following the EC’s decision to disqualify the party’s parliamentary candidate (PC) for Amenfi Central, Joana Gyan Cudjoe.

“This morning, our lawyers, in a swift and decisive action, served the Electoral Commission with court documents on the motion for an interlocutory injunction. The message is loud and clear: we will not allow this disqualification to stand,” it said.

“The court documents have been filed and we have secured an injunction to restrain the EC from printing ballot papers, from issuing notices of the poll and from taking any further steps toward the election in Amenfi Central until this matter is fully resolved,” the party’s General Secretary, Fifi Fiavi Kwetey, stated at a press conference last Thursday.

He said the party would fight back to protect the democracy of the country and ensure that Mrs Cudjoe was on the ballot come December 7 on the ticket of the NDC.

“The NDC will use every legal weapon in its arsenal to ensure that the EC’s unlawful actions are reversed. This is a fight for our democracy and we will not lose.”

Speaking on the issue, the Director of Legal Affairs of the NDC, Edudzi Tamakloe, explained that on May 13 last year, Ms Gyan Cudjoe was elected PC for Amenfi Central, which was contested with a lawsuit at the Sekondi High Court after it temporarily restrained her from being the PC on the ticket of the party.

Mr Tamakloe indicated that the NDC appealed the earlier injunction placed on the elected PC and was given July 17 by the Sekondi Court of Appeal to hear the matter, but were later informed by the Court that it would only sit in October this year.

He said the NDC’s Functional Executive Committee decided to annul the said election, whose outcome was contested, resulting in the injunction on the winner to allow for a fresh election on September 8 this year.

He said Ms Cudjoe won the rerun of the election supervised by the EC in a contest against the incumbent MP, Peter Kwakye-Ackah.

Mr Tamakloe added that the NDC adhered to every legal requirement, with the EC also being part of every step the party took in conducting and declaring Ms Gyan Cudjoe as the parliamentary candidate of the NDC at Amenfi Central.
